学びの準備 ／Prepare to learn	ねらい ／Goal Our everyday disputes are ultimately resolved by considering the existence and amount of the right to claim damages (Articles 415 and 709 of the Civil Code). It all boils down to money. For example, a victim of a traffic accident can claim compensation for medical expenses and lost or reduced income. A wife who is a victim of her husband's infidelity not only desires divorce but also claims compensation for emotional distress from both her husband and his mistress. A buyer who loses in a double transfer of real estate can claim compensation from the seller for the market value of the property. Late payments incur late payment interest. We will examine various issues related to monetary claims, focusing primarily on contract law, where payment can be claimed. メッセージ ／Message We live in a capitalist society where everything can be exchanged for money, and it is important to understand legally that we have the right and obligation to demand payment for money. 到達目標 ／Attainment Targets Understand the fundamental concepts of contract law.
学びの実践 ／Learning Practices	授業計画 ／Class Plan I will discuss the following topics: Various situations in which compensation for damages becomes an issue Requirements and effects of liability for breach of contract and tort liability A review of the expansion of contractual liability What is damage? - The difference theory What is damage? - The factual theory of damage Various issues surrounding the calculation of lost profits Defining the scope of compensation for damages Characteristics of compensation for damages as a monetary obligation Effects of offering or depositing a portion of compensation for damages Adjustment of overlapping compensation Timing of calculating the amount of compensation for damages テキスト・参考文献・資料など ／Textbooks, references, materials, etc. There is no textbook. Reference materials will be provided as needed. 学びの手立て ／Way of learning The wording of the articles is important. 評価 ／Evaluation A final exam will be administered (100% of the evaluation).
